SERVICE CONTRACTS
AB 63 (Chap. 74) adds CC §1794.45
Background: Consumers sometimes misplace service contracts.
The new law: Requires retailers that sell service contracts to do one of the following during the period that the service contract is in effect:
- Maintain contract information that includes a description of the terms and conditions of the service contract and provide that information to the purchaser upon request, or
- Obtain a copy of the service contract and provide that copy to the requester within 10 business days after receiving the request.
This statute does not apply to a vehicle service contract that covers the repair, replacement, or maintenance of a motor vehicle or watercraft.
