Housing: New Uniform Housing Discrimination Laws

(B&P Code Section 10177 et al, Civil Code Section 782 et al, Health & Safety Code Section 33050 et al)

Several laws prohibit discrimination against persons who are members of a protected class. The list of protected classes, however, varies from law to law. For example, the law that prohibits discrimination in membership in clubs created by homeowners associations only covers "race, color, creed, religion, national origin, and sex."  A similar law that applies to clubs established by mobile home parks includes these categories plus “ancestry and marital status,” but excludes “creed.” These inconsistencies create confusion for those charged with implementing and complying with these laws.

This new law, known as the Civil Rights Housing Act of 2006, requires that all nondiscrimination laws relating to financing, construction, and occupancy of housing be consistent with the Fair Employment and Housing Act, which makes it illegal to discriminate people because of their race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income, or disability.
